1. Acceptance of Terms
By accessing or using Dasceq's platform, services, and related products (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you or the entity you represent ("Customer," "you," or "your") and Dasceq Inc. ("Dasceq," "we," "us," or "our").
If you do not agree to these Terms, you may not access or use the Services. Your continued use of the Services following any changes to these Terms constitutes acceptance of those changes.
These Terms apply to all users of the Services, including without limitation creditors, financial institutions, lenders, and their authorized representatives.
2. Description of Services
Dasceq provides an AI-powered accounts receivable platform that enables users to manage, automate, and optimize payment recovery campaigns across multiple communication channels including voice calls, SMS, email, and other digital channels.
Our Services include but are not limited to: campaign management tools, multi-channel communication capabilities, AI-driven analytics and insights, predictive scoring models, compliance monitoring, and reporting dashboards.
Dasceq reserves the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice.
3. Account Registration
To access the Services, you must register for an account by providing accurate, current, and complete information. You are responsible for safeguarding your account credentials and for all activities that occur under your account.
Dasceq reserves the right to refuse service, terminate accounts, or cancel orders at our sole discretion.
4. Acceptable Use
You agree to use the Services only for lawful purposes and in accordance with these Terms, including compliance with all applicable federal and state regulations governing accounts receivable communications, including the Telephone Consumer Protection Act (TCPA) and CFPB Regulation F.
You shall not use the Services to engage in any harassing, abusive, or unlawful communications with consumers or third parties.
5. Intellectual Property
The Services and all content, features, and functionality thereof are owned by Dasceq, its licensors, or other providers and are protected by copyright, trademark, patent, and other intellectual property laws.
Subject to your compliance with these Terms, Dasceq grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for your internal business purposes.
6. Payment Terms
Access to the Services is provided on a subscription basis. All fees are non-refundable unless otherwise specified in writing. Dasceq reserves the right to change its prices upon notice to you.
If you fail to pay any fees when due, Dasceq may suspend or terminate your access to the Services.
7. Data Usage
As between Dasceq and Customer, Customer owns all right, title, and interest in Customer Data. Dasceq will use Customer Data only to provide the Services and as described in our Privacy Policy.
Dasceq may use aggregated, anonymized data for analytics, benchmarking, and product development purposes.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DASCEQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.
DASCEQ'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
9. Governing Law
These Terms shall be governed by the laws of the State of Texas. Any legal action shall be brought in the courts located in Travis County, Texas.
